California has passed Prop 8, a state constitutional amendment that rules same sex marriage as illegal. California Attorney General Kamala Harris refuses to defend the ban on same sex marriage and files a brief with the United States Supreme Court, who rules it as unconstitutional. Kamala performs the first gay marriage ceremony in the history of the state.

The Biden-Harris administration has enacted numerous policies to protect LGBTQ+ rights, focusing on anti-discrimination in housing, healthcare, and education, reversing the transgender military ban, and signing the Respect for Marriage Act.

 

The administration has appointed over 200+ LGBTQ+ individuals across government levels and has strongly advocated for the Equality Act

President Joe Biden signed gay marriage legislation. The new law is intended to safeguard gay marriages if the U.S. Supreme Court ever reverses Obergefell v. Hodges, its 2015 decision legalizing same-sex unions nationwide. The new law also protects interracial marriages. In 1967, the Supreme Court in Loving v. Virginia struck down laws in 16 states barring interracial marriage.
